Search for evidence in favor of the defense
The principle of equality between accusation and defense in the context of criminal proceedings is enshrined in art. 111 of the Constitution of the Italian Republic. The Italian legal system therefore allows both parties to seek and provide evidence in their favor to be asserted in criminal proceedings.
Defensive investigations are governed by Law no. 397 of 7 December 2000 and by art. 222 and 327-bis of the Code of Criminal Procedure. In the context of defensive investigations, to identify evidence useful for the defense of his client, the lawyer has the right to use the help of a private investigator.
Luca Leonardo D'Agostini is a private investigator, former owner of the investigative agency Luca D'Agostini Investigazioni, authorized by the Government Office of Rome (former Prefecture) as far as carrying out investigations on behalf of private individuals (the so-called family investigations, personal and business). In criminal investigations Luca Leonardo D'Agostini acts personally as a private investigator authorized by the Government Office of Rome (former Prefecture) in carrying out criminal investigations and therefore can be appointed as defense technical consultant.
The criminal investigation activities carried out by the private investigator Luca Leonardo D'Agostini are as follows:
- tracing of persons and witnesses;
- investigation of the reliability of witnesses against;
- investigations into the confirmation of alibis;
- researches useful elements for carrying out further investigations;
- fingerprint analysis reports;
- audio and video recording appraisals;
- ballistic appraisals and scientific analyzes on finds;
- technical-scientific inspections and surveys on the crime scene;
- informal conversations with people informed of the facts.
